Montesquieu is famous as a tireless critic of despotism, which he associates overtly with Asia and the Middle East and not with the apparently more moderate Western models of governance found throughout Europe. However, Vickie B. Sullivan argues that a creaful reading of Montesquieu's enormously influential The Spirit of the Law reveals the surprising result that he recognizes that Europe itself is susceptible to despotic practices - and that the threat emanates not from the East but rather from (...) certain despotic ideas that inform Western institutions and practices. Sullivan guides readers through Montesquieu's sometimes veiled yet sharply critical accounts of Machiavelli, Hobbes, Aristotle, and Plato, as well as various Christian thinkers have brough forth despotic ideas in the form, for example, of brutal Machiavellianism, of Hobbes's justifications for the rule of one, of Plato's reasoning that denied slaves the right of natural defense, and of the Christian teachings that equated heresy with treason. Such ideas, Montesquieu shows, inform such revered European institutions as the French monarchy and the Roman Catholic Church. Machiavelli's ambiguous treatment of religion has fueled a contentios and long-standing debate among scholars. Whereas some insist that Machiavelli is a Christian, others maintain he is a pagan. Sullivan mediates between these divergent views by arguing that he is neither but that he utilizes elements of both understandings arrayed in a wholly new way. She develops her argument by distinguishing among the three Romes that can be understood as existing in Machiavelli's political thought: the first is the Rome of (...) the Christian era, dominated by the pope; the second is the republican Rome of pagan times, which Machiavelli praises; and the third is an idealized Rome that is neither entirely pagan nor entirely Christian. Certain English writers of the seventeenth and early eighteenth centuries, whom scholars often associate with classical republicanism, were not, in fact, hostile to liberalism. Indeed, these thinkers contributed to a synthesis of liberalism and modern republicanism. As this book argues, Marchamont Nedham, James Harrington, Henry Neville, Algernon Sidney, and John Trenchard and Thomas Gordon, the co-authors of a series of editorials entitled Cato's Letters, provide a synthesis that responds to the demands of both republicans and liberals by offering a politically (...) engaged citizenry as well as the protection of individual rights. Walter Moyle's work, An Essay upon the Constitution of the Roman Government, is much more Machiavellian than it initially announces itself to be. Informed by James Harrington's and Niccolò Machiavelli's earlier commentaries on Rome, Moyle readily embraces that on which both of his predecessors agree—the desirability of a republic that seeks armed increase. Harrington, though, explicitly disagrees with Machiavelli's embrace of a tumultuous republic that seeks a return to its beginning through fostering fear. In contrast to Machiavelli, Harrington looks to (...) economic and institutional arrangements that will render a republic so serene and stable that he claims immortality for it. Although initially Moyle forthrightly endorses Harrington's analysis, he ultimately relies on the harshest teachings of Machiavelli to maintain a republic, a reliance which finds him endorsing the distinctively Machiavellian directives to suspect, accuse, and punish its leaders in such a way as to return the republic to its beginnings. These teachings make Moyle's work a vessel for the transmission of a stern, aggressive republicanism. Even in this eventual enthusiastic embrace of Machiavelli's teachings, however, Moyle still displays some hesitation in citing him as the sole source for them as his attributions couple the Florentine's name inaccurately with other, more reputable republicans. When ethics committees are consulted about patients who have or need court-appointed guardians, they lack empirical evidence about several common issues, including the relationship between guardianship and prolonged, potentially medically unnecessary hospitalizations for patients. To provide information about this issue, we conducted quantitative and qualitative analyses using a retrospective cohort from Veterans Healthcare Administration. To examine the relationship between guardianship appointment and hospital length of stay, we first compared 116 persons hospitalized prior to guardianship appointment to a comparison group (n (...) = 348) 3:1 matched for age, diagnosis, date of admission, and comorbidity. We then compared 91 persons hospitalized in the year following guardianship appointment to a second matched comparison group (n = 273). By around the age of 5½, many children in the United States judge that numbers never end, and that it is always possible to add 1 to a set. These same children also generally perform well when asked to label the quantity of a set after one object is added (e.g., judging that a set labeled “five” should now be “six”). These findings suggest that children have implicit knowledge of the “successor function”: Every natural number, n, has a successor, n (...) + 1. Here, we explored how children discover this recursive function, and whether it might be related to discovering productive morphological rules that govern language‐specific counting routines (e.g., the rules in English that represent base‐10 structure). We tested 4‐ and 5‐year‐old children’s knowledge of counting with three tasks, which we then related to (a) children’s belief that 1 can always be added to any number (the successor function) and (b) their belief that numbers never end (infinity). Children who exhibited knowledge of a productive counting rule were significantly more likely to believe that numbers are infinite (i.e., there is no largest number), though such counting knowledge was not directly linked to knowledge of the successor function, per se. Also, our findings suggest that children as young as 4 years of age are able to implement rules defined over their verbal count list to generate number words beyond their spontaneous counting range, an insight which may support reasoning over their acquired verbal count sequence to infer that numbers never end. Parents who are facing decisions about life-sustaining treatment for their seriously ill or dying child are supported by their child's doctors and nurses. They also frequently seek other information sources to help them deal with the medical and ethical questions that arise. This might include written or web-based information. As part of a project involving the development of such a resource to support parents facing difficult decisions, some ethical questions emerged. Should this information be presented in a strictly neutral fashion? (...) Is it problematic if narratives, arguments or perspectives appear to favour stopping over continuing life-sustaining treatment? Similar questions might arise with written materials about decisions for adults, or for other ethically contentious decisions. This paper explores the meaning of ‘balance’ in information provision, focusing particularly on written information about life-sustaining treatment for children. We contrast the norm of non-directiveness in genetic counselling with the shared decision-making model often endorsed in end-of-life care. We review evidence that parents do not find neutrality from medical professionals helpful in discussions. We argue that balance in written information must be understood in the light of the aim of the document, the most common situation in which it will be used, and any existing biases. We conclude with four important strategies for ensuring that non-neutral information is nevertheless ethically appropriate. (shrink)

SummaryScholars have pointed to Montesquieu's influence on Rousseau's work generally. Other scholars, who focus more intently on the Letter to d'Alembert, discern a crucial but limited influence of Montesquieu in two of Rousseau's teachings there: first, that some practices, including the theatre, can be appropriate and even wholesome for some societies, while noxious for others; and second, that mores are important in determining what types of laws and institutions a given people can tolerate and maintain. Careful consideration of Rousseau's Letter (...) in light of Montesquieu's Persian Letters and Spirit of the Laws reveals a much more pervasive influence, however. Rousseau's depictions of the theatre as well as his discussions of the role of women in both French and English society reveal that the Letter bears a striking resemblance to, and, in fact, appears to be a response to, aspects of Montesquieu's thought. Montesquieu's captivating depictions of the sociability that the French theatre can engender was surely an obstacle for Rousseau's opposition to its influence in Geneva. In resisting such influence, Rousseau counters many of Montesquieu's specific arguments and judgements. (shrink)

Montesquieu calls Machiavelli a 'great man' in his Spirit of the Laws, and commentators have demonstrated his knowledge of and indebtedness to the Florentine. Careful consideration of his treatment of Machiavelli in this work, however, suggests that Montesquieu has grave misgivings regarding Machiavelli's form of republicanism. Indeed, far from regarding Machiavelli's republicanism as an embodiment of liberty, the Frenchman suggests that it is actually despotic because it too readily sacrifices the security of the individual in the name of the state's (...) political interest in longevity. Montesquieu indicates that one of his very purposes in the Spirit is to substitute his own middle way for the ugly extremes of Machiavelli's harsh form of republicanism. (shrink)

Because a thorough investigation of Machiavelli's thought and the thought of those who explicitly drew on it can be achieved only through the kind of Herculean labours displayed by Pocock in his Machiavellian Moment, I propose here to examine only two works by admirers of Machiavelli: Harrington's Oceana, which imports the Italian Renaissance to England's shores, and John Trenchard and Thomas Gordon's Cato's Letters, which prepares its departure for America. I argue that a re-examination of these critical links in the (...) civic humanist chain does not bear out the civic humanist interpretation of Machiavelli's influence. Further, because Pocock, at times, asserts that what is crucial for establishing Machiavelli's participation in this tradition is not, in fact, what Machiavelli said, but how others read him, I believe that this examination begins to raise significant questions about the validity of Pocock's portrait of a Machiavellian civic humanist tradition. This study of philanthropy among large Black-owned businesses provides insights into a sector of business giving which has not been studied. Results indicate that philanthropy and ethical justifications play a more important role in minority business enterprises than in non-minority firms studied previously.

The paper offers an analysis of Protagoras’ fr. DK 80 B 1 and rejects the traditional reading of Protagoras as relativist. By considering the ipsissima verba that Protagoras makes use of in his passage, it is argued that alternative interpretations are possible, of which epistemological reism and psychological individualism are proposed. On a more general level, it is discussed to what extent Protagoras’ fragment contains descriptive rather than normative claim.

Vacillating and mixed emotional experiences are often difficult to explore and understand because they confront the limits of our language's ability to capture private experiences in extreme or abnormal circumstances. In this paper, we build upon remarks by Wittgenstein (1953) to present a conceptual-discursive perspective based on naturalistic examples of individuals vacillating between pride and other emotions. This perspective is used to show how relevant emotion theories contain conceptual errors of the sort identified by Wittgenstein. The “assembled reminders” of shifts (...) between pride and other emotions are presented in contrast to analyses that focus on people's identification of causes of emotions, an approach which leads to theoretical speculation about underlying appraisal set changes or discussion of the empirical justification of cognitive ontology. We bypass a direct confrontation on these issues by examining how people's talk about the content of vacillating and mixed emotional experiences (i.e., aspect shifts) augments a shared “emotionology” with creative expressions and poetic comparisons. This last point is illustrated by the emotional instability experienced by individuals with Borderline Personality Disorder (BPD). Support for the conceptual-discursive perspective is provided by the success of a particular therapeutic approach, the Conversational Model, in ameliorating the developmental disruption of BPD by encouraging participation in empathic conversations. We conclude that a conceptual-discursive perspective undermines the cognitive appraisal “picture” of vacillating emotions and adds to our understanding. (shrink)

As much as I try to dissuade my students from using religious legalism to justify the rightness or wrongness of certain sexual practices, I find it almost impossible to break them of the bad habit of using such phrases as “Because the Church teaches...” or “Because the Bible says...”. Even when I counter by saying, “The Church teaches that something is good because it is good and not because the Church says it is good, and such goodness is grounded in the natural law and a sound anthropology,” such legalism still persists. And so, to read Pruss’s extensive analysis of sexual ethics using both personalist and Thomistic principles as well as what we have received from divine revelation is a much-needed tonic not only for students of theology and philosophy but for all those interested in discovering the role of human reason and biology in crafting a sexual ethic.After an introduction, the proper beginning of Pruss’s analysis is found in chapter 2. Here, the author discusses love and its forms with a particular focus on the meaning of agapē in the New Testament. Pruss argues that, philosophically speaking, we should love everyone. But love should not be understood as monolithic. There are various kinds of love: agapē, philia, and erōs. The New Testament understanding of agapē contains the other two, for it is love itself. This kind of love is a love that loves the other as the other is, for the other’s sake, and in a way that is appropriate to that person in the light of objective facts. Moreover, this kind of love is not simply a feeling or an emotion but is concentrated in an action that is an expression of one’s will.In chapter 3, Pruss takes up the issue of desire. He evaluates desire in two ways: (1) desire and libido, and (2) sexual desire, need, and pleasure. He [End Page 485] concludes that sexual desire is not a need in the same way that we desire food, drink, communication, love, and to be loved. Without these latter, human life would be seriously lacking or, in the case of food and drink, quickly cut short. Second, he observes that circumstances may not be appropriate for fulfilling one’s sexual desire. Finally, while human life would be seriously compromised by the lack of food, drink, communication, love, and the need to be loved, abstaining from the fulfillment of sexual desire even over a long period of time would not be detrimental to human well-being in the same way.Pruss does not imply by the preceding that sexuality does not matter. Chapter 4, in fact, deals with the meaningfulness of sexuality. There are two sets of rules regarding sexuality and its expression. Some rules are moral in nature, like the prohibition against rape. With respect to the moral rules regarding sexuality, Pruss highlights casual sex, sexual assault, gay rights, and romantic love. Apart from sexual assault and rape—both of which lack consent—casual sex, homosexual sex, and romantic love have the following in common, namely, that sex is indeed innately important to human beings and that sex aspires to be romantic in nature. The history of Athenian relations with Sicily in the fifth century is beset with difficulties; and no part of it, perhaps, is more obscure than the story of what is commonly known as the First Sicilian Expedition, which set sail from Athens in the late summer of 427 under Laches, and was reinforced under Pythodorus, Sophocles and Eurymedon in the winter of 426.

Cocaine use disorder is associated with maladaptive decision-making behavior, which strongly contributes to the harmful consequences of chronic drug use. Prior research has shown that cocaine users exhibit impaired neuropsychological test performances, particularly with regard to attention, learning, and memory but also in executive functions such as decision-making and impulse control. However, to what extent cocaine users show impaired decision-making under risk without feedback has not yet been investigated systematically. Therefore, to examine risk-taking behavior, 31 chronic cocaine users and 26 (...) stimulant-naïve healthy controls who were part of the Zurich Cocaine Cognition Study, performed the Randomized Lottery Task (RALT) with winning lotteries consisting of an uncertain and a certain prospect. Results revealed that risky decisions were associated with male sex, increased cocaine use in the past year, higher cocaine concentrations in the hair, and younger age. In addition, higher levels of cocaine in the hair and cumulative lifetime consumption were associated with risky decisions, whereas potentially confounding factors including cognition and psychiatric symptoms had no significant effect. Taken together, our results indicate that cocaine users who increased their consumption over a period of 1 year show deficits in the processing of risky information accompanied with increased risk-taking. Future research should analyse whether risky decisions could potentially serve as a prognostic marker for cocaine use disorder. (shrink)

Summary Recent evidence from Diocesan and Office for Standards in Education inspections under the Education Act 1992 seems to suggest that while pupils in Catholic schools in England and Wales obtain high levels of academic success at Key Stage Two and Key Stage Four compared with those attending other schools in the maintained sector, their achievements in Advanced level examinations are lower than one would expect. The article begins with a comparison of Roman and Greek approaches to history, employing a distinction between narrative and logic. It goes on to consider the impact of Christianity, the relationship between enlightenment narratives and philosophical developments regarding the nature of causation, and the Hegel/marx critique of the kinds of (...) empiricism associated with Hume. Settlem't. 500 people will secure the settlement 1000 perfect it. desires supplys of necessarys till that time Excerpt from Carolina Memoranda in the handwriting of John Locke, Esq., 15 September 1670 Within the last decade, scholars such as James Tully, Barbara Arneil, and Bhikhu Parekh have performed a crucial intervention on modern constitu-tionalism's behalf. 1 Not only has constitutionalism in the modern age been [End Page 425] plagued by assumptions of cultural uniformity and an on-going inability to adjudicate between competing cultural claims, but it has been unable effectively to diagnose those limitations and dilemmas. The root of the problem, James Tully suggests, is ultimately a matter of historical perspective. "[T]he tendency," he writes, "is not to notice the philosophical and ideological debates over the last three hundred years... only the result of these debates is seen—the victorious modern language of constitutional uniformity—and claims for recognition are viewed through its framework as if it were impartial and universal." 2 In response Tully and others have sought to tackle this predicament at its historical root. Identifying modern constitutionalism's colonial origins as a significant part of the problem, their studies address the development of constitutionalism and colonialism as an entwined phenomenon in the early modern period, focusing particularly on the British-American context. In this sense, Locke's Two Treatises of Government stands as an exemplary illustration of the period's entangled colonial and constitutional temperaments. Well-known for its influential articulation of compact and resistance, the Two Treatises, Barbara Arneil argues "were written as a defence of England's colonial policy in the new world against the sceptics in England and the counter-claims of both the aboriginal nations and other European powers in America." 3 Accordingly, present-day constitutionalism continues to bear the weighty legacy of those colonial rationales. "[T]he language of modern constitutionalism," Tully further explains, "which has come to be authoritative was designed to exclude or assimilate cultural diversity and justify uniformity. The design is difficult to see because this 'modern' language has become the customary way of thinking about, reflecting on and envisioning a just constitutional order." Ultimately, Tully submits, citing Wittgenstein, "A picture held us captive. And we could not get outside it, for it lay in our language and language seemed to repeat it to us inexorably." 4This much-needed thickening of constitutionalism's historical context has enriched our awareness of constitutionalism's vexed origins, as it has proffered potent tools for interrogating current cultural adjudication. Yet, a troubling predicament persists. As if caught within the tenacious grip of the language of modern constitutionalism, Tully, Arneil, and Parekh insistently portray seventeenth-century British-American colonialism solely as a straightforward process of appropriation and assimilation without addressing or incorporating the [End Page 426] complex and contingent elements of that history in its emergence. Lacking the various negotiations and accommodations between settler and indigene in ambition and actualization, their portrayals crucially underplay the dynamic relationship between theories of constitutionalism and practices of colonialism—an approach that ultimately serves to reinscribe the narrative of triumphalist progress within their critiques. 5This problematic is the context for my reading of the Fundamental Constitutions of Carolina,1669... Abstract:This article repositions Thomas Arnold as a major nineteenth-century historian through an analysis of his most important work, the History of Rome (1838–42). While scholars have focused primarily on Arnold's role as headmaster of Rugby School and Liberal Anglican theologian, I examine his historical contribution in the context of the Romantic movement. Building on the work of B. G. Niebuhr and Giambattista Vico, Arnold interpreted the contest between the patricians and plebeians at Rome as emblematic of a universal class struggle, (...) in which failure to find a compromise between the rich and the poor would inevitably lead to disaster. The following four assumptions plausibly describe the ideal rational agent. (1) She knows what her beliefs are. (2) She desires to believe only truths. (3) Whenever she desires that P → Q and knows that P, she desires that Q. (4) She does not both desire that P and desire that ~P, for any P. Although the assumptions are plausible, they have an implausible consequence. They imply that the ideal rational agent does not believe and desire contradictory propositions. She neither (...) desires the world to be any different than she thinks it is, nor thinks it is any different than she desires it to be. The problem of preserving our intuitions about desire, without embracing the implausible conclusion, is what I call “the Wishful Thinking Puzzle.” In this paper, I examine how this puzzle arises, and I argue that it is surprisingly difficult to solve. Even the decision theoretic conception of desire is not immune to the puzzle. One approach, the contrastive conception of desire, does avoid the puzzle without being ad hoc, but it remains too inchoate to win our full confidence. (shrink)

This paper discusses the role of the Australian Institute of Criminology in monitoring inmate deaths in custody on a national basis. It also provides a descriptive overview of Australian Indigenous and non-Indigenous inmate deaths in custody during the eighteen-year period between 1980 and 1998.In October 1987, the Royal Commission into Aboriginal Deaths in Custody commenced investigating the deaths of Australia's Indigenous people in custody throughout Australia between January 1, 1980 and May 31, 1989. RCIADIC's task was to examine the circumstances (...) of the deaths; the actions taken by authorities; and the underlying causes of Indigenous deaths in custody, including social, cultural, and legal factors. The investigation found that the major factor contributing to the high number of Indigenous deaths in custody was the disproportionately higher rates at which Indigenous people come into contact with the criminal justice system. RCIADIC concluded that the most significant reason for this contact was the severely disadvantaged social, economic, and cultural position of many Indigenous people. (shrink)
